Terms of Use

These Terms of Use ("Terms") are an agreement between you and Task Innovation LLC, the company in Yelm, Washington, USA that operates Choretasktik ("Choretasktik," "we," "us," or "our"). They apply to the Choretasktik mobile app and our web pages. By creating an account or using Choretasktik, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Choretasktik.

1. Who can use Choretasktik

• You must be at least 18 years old and able to enter into a binding contract.
• Choretasktik is available only in the United States, and you must be located in the United States to use it.
• Customer and driver accounts are separate. Drivers must sign up for a driver account and meet the driver requirements in section 8.
• You may not use Choretasktik if we have previously suspended or removed your account.

2. Your account

• Provide accurate information and keep it up to date.
• Keep your password private. You are responsible for all activity on your account.
• Tell us right away at phuong@hereappzyz.com if you think someone else has accessed your account.

3. What Choretasktik does

Choretasktik is a marketplace. It lets people list items for sale, list and book local services, and request deliveries or errands, and it lets independent drivers find and accept those jobs. Choretasktik does not sell the listed items, does not perform deliveries or services itself, and is not a party to the agreements between users. Drivers are independent and are not employees, agents, or partners of Choretasktik or Task Innovation LLC. You are responsible for your own listings, requests, and conduct, and for following all applicable laws.

4. Community rules: zero tolerance

Choretasktik has zero tolerance for objectionable content and abusive users. You may not post, send, or do anything on Choretasktik that:

• harasses, bullies, threatens, stalks, or intimidates anyone;
• promotes hate or attacks people based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or age;
• is sexually explicit or pornographic, or sexualizes anyone;
• threatens or encourages violence, self-harm, or illegal activity;
• offers illegal, stolen, counterfeit, or dangerous items or services, including illegal drugs and weapons;
• is fraudulent, deceptive, or spam, including fake listings, fake reviews, and scams;
• impersonates someone else or misrepresents who you are;
• shares another person's private information without their permission; or
• infringes anyone's intellectual property, privacy, or other rights.

Choretasktik automatically filters offensive language in listings, requests, messages, reviews, and names. Content that breaks these rules is removed, and the accounts responsible are suspended or permanently terminated, with or without warning. We may also report illegal activity to law enforcement.

5. Reporting and blocking

• You can report any listing, message, request, or person from within the app, and you can block any user. Blocked users cannot message you, and you will not see each other's listings.
• Our team reviews every report within 24 hours and acts on it. When content or behavior breaks these Terms, we remove the content and suspend or remove the account responsible.

6. Payments and fees

• Payments and payouts are processed by Stripe. By paying or receiving money through Choretasktik, you also agree to Stripe's terms.
• Before you pay, checkout shows an itemized total: the item price or the amount you offer for a service, a driver fee for item deliveries, a platform fee, and a convenience fee. The total shown is the amount you are charged.
• Your payment is held securely when you check out. It is released to the driver, and for item purchases to the seller, only after the requester confirms that the job is complete.
• Only the requester can confirm that a job is complete. Drivers cannot mark a job complete on the requester's behalf.
• Drivers and sellers are paid through Stripe Connect. Drivers can withdraw their available balance; the amount is set aside immediately and paid out to their Stripe Connect account after review.
• All prices are in US dollars. You are responsible for any taxes that apply to what you sell or earn.

7. Cancellations and refunds

• A requester can cancel a request in the app until a driver accepts it. Any payment is then refunded in full to the original payment method.
• Once a driver has accepted, contact us to cancel. We will review the cancellation and any refund with you and the driver.
• A driver can cancel an accepted, scheduled job only with at least 24 hours' notice. The job is then offered to other drivers.
• If something is wrong with a delivery or service, contact us before you confirm completion. Confirming completion releases the payment, and refunds after completion are at our discretion unless the law requires otherwise.

8. Rules for drivers

• Drivers must be at least 18, located in the United States, and hold a valid government-issued photo ID. If you drive, you must have a valid driver's license, registration, and the insurance required by law, and use a vehicle suitable for the jobs you accept.
• Every pickup must be verified in the app with a selfie photo of you with the item, taken at the pickup. The drop-off address is shown only after the pickup is verified.
• You must complete every job you accept yourself. Subcontracting, which means handing a job to anyone else, is strictly prohibited and is grounds for immediate termination.
• Treat customers, sellers, and their property with care, and obey all traffic and safety laws.
• You are responsible for your own vehicle, expenses, insurance, and taxes.

9. Your content

You keep ownership of the content you post, such as listings, photos, messages, and reviews. You give Task Innovation LLC a non-exclusive, royalty-free, worldwide license to host, store, display, and use that content to operate Choretasktik, and you confirm that you have the right to post it. We may remove any content at any time.

10. Disclaimers

Choretasktik is provided "as is" and "as available." We do not guarantee the quality, safety, or legality of any item, service, or delivery, the accuracy of listings, or the conduct of any user, and we do not guarantee that the app will always be available or free of errors. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, Task Innovation LLC and its owners, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of Choretasktik or from any dealings between users. Our total liability for any claim relating to Choretasktik is limited to the greater of the amount you paid through Choretasktik in the 12 months before the claim or US $100. Some states do not allow these limitations, so some of them may not apply to you.

12. Indemnity

You agree to defend and hold harmless Task Innovation LLC from claims, losses, and expenses, including reasonable attorneys' fees, arising from your content, your use of Choretasktik, or your violation of these Terms or the law.

13. Suspension and termination

We may suspend or terminate your account, remove your content, or limit your access at any time if you break these Terms, if the law requires it, or to protect our users. You may stop using Choretasktik at any time and delete your account from Profile in the app or at https://dusty-partridge-846.convex.site/account-deletion. Earnings for jobs you completed before termination are paid out unless they are connected to fraud or a violation of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules. Any dispute relating to these Terms or Choretasktik will be resolved in the state or federal courts located in Washington State, and you and we agree to their jurisdiction. Before filing a claim, please contact us so we can try to resolve the issue informally.

15. Changes to these Terms

We may update these Terms from time to time. We will notify you in the app or by email about material changes, and we may ask you to accept the updated Terms before you continue. If you keep using Choretasktik after changes take effect, you accept the updated Terms.
